About the website

Welcome to www.2nu.vision (the 'Website'). The Website provides you with an opportunity to browse and purchase various products that have been listed for sale through the Website (the 'Products '). The Website provides this service by way of granting you access to the content on the Website (the 'Purchase Services ').

The Website is owned by 2NU (H.K.) Access to and use of the Website, or any of its associated Products or Services, is provided by 2nu. Please read these terms and conditions (the 'Terms ') carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.  2nu reserves the right to review and change any of the Terms by updating this page at its sole discretion. Acceptance of the Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by 2nu in the user interface.

Purchase of Products and Returns Policy

In using the Purchase Services to purchase Products through the Website, you agree to pay the purchase price listed on the Website for the relevant Product (the "Purchase Price").

Payment of the Purchase Price may be made through PayPal, Shopify Payments, and other available payment gateway providers (the "Payment Gateway Provider"). In using the Purchase Services, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable terms and conditions, privacy policies, and other relevant legal documentation provided by the relevant Payment Gateway Provider.

Following confirmation of payment by 2nu, you will be issued with a receipt confirming that payment has been received, and 2nu may record your purchase details for future reference.

Please note that some banks or credit card companies may apply fees for online shopping transactions. These charges are imposed directly by the relevant bank or card issuer and remain the responsibility of the customer.

Please note that the destination may impose customs duties, import taxes or related charges. Where those charges are imposed, they are not included in the product price or the shipping charge and remain the responsibility of the customer.

Eligible sunglasses may be returned or exchanged within 14 days of delivery, provided they are undamaged, unworn beyond normal try-on, and returned with all tags, accessories and packaging intact. Normal try-on is allowed; wearing them for exercise or outdoor activities is not normal try-on.

Customers are responsible for the cost of returning Products to our designated fulfillment centre, unless otherwise agreed in writing by 2nu.

Shipping charges paid on the original order are non-refundable.

Where an order originally qualified for free shipping, the original shipping cost incurred by 2nu will be deducted from the refund amount.

Returns, exchanges, and refunds are subject to inspection upon receipt. 2nu reserves the right to refuse returns that do not meet the above conditions.

Prescription products, customised products, TryOn products, Online Outlet items and products marked Final Sale are not eligible for returns, exchanges or refunds. Running Caps are not eligible for returns or refunds. This does not affect any rights under applicable consumer law.

We issue approved refunds to the original payment method within 7 business days after receiving and inspecting the returned item. The time it takes for the refund to appear in your account depends on your bank or payment provider; please contact them for the expected posting time.

Nothing in this clause excludes any rights you may have under applicable consumer protection laws.

Orders Unable to Be Shipped Due to Missing Delivery Information

Customers are responsible for providing complete, accurate, and valid information required for delivery, including but not limited to the delivery address, recipient details, contact information, and any information required for logistics, customs clearance, identity verification, or import procedures in the destination country or region.

For orders shipped to Taiwan, customers may be required to provide additional information required by local logistics, customs clearance, or real-name verification procedures, including but not limited to the recipient’s full Chinese name, EZWAY (易利委) identity verification information, or any other necessary details.

If 2nu is unable to dispatch an order within ninety (90) calendar days from the date of order placement due to the customer’s failure, delay, or refusal to provide the required information, the order will not be eligible for a refund, and 2nu will not arrange any refund for that order.

If the relevant order or Product remains with 2nu or its designated fulfilment, warehousing, or logistics partner for more than three hundred and sixty (360) calendar days due to the above circumstances, 2nu reserves the right to cancel the order. Once cancelled, no refund, compensation, credit, or reimbursement will be provided in respect of the order, Product, shipping fees, or any other amounts paid, except where required by applicable law.

Warranty

If you deal as a consumer under the Sale of Goods Ordinance (Cap. 26), goods we supply in the course of our business are sold subject to the implied conditions that apply under sections 15 and 16 of that Ordinance. Section 15 implies correspondence with description where there is a sale by description. Section 16 implies merchantable quality except as provided in section 16(2), and implies reasonable fitness for a particular purpose only where that purpose was made known and the other conditions in section 16(3) are met. This statutory-rights summary does not itself create any warranty in addition to those applicable statutory conditions, and it does not limit or remove any express commitment or other term in these Terms, including commitments about manufacturing defects, damage during delivery, and the Lifetime Care Program. As against a person dealing as consumer, those implied conditions cannot be excluded or restricted by a contract term (Control of Exemption Clauses Ordinance (Cap. 71) section 11(2)).

Our warranty covers manufacturing defects and damage during delivery. Normal wear and tear, ageing and damage from daily use are not covered by this warranty. For these situations, eligible sunglasses can use our paid Lifetime Care Program.

If your item arrives with a manufacturing defect or delivery damage, notify Customer Care at care@2nu.vision within 24 hours of delivery, with your order details and clear photos of the issue.

Lifetime Care Program

Eligible replacements under the Lifetime Care Program are for the same model, frame colour and lens configuration as the original sunglasses purchased. If that item is no longer available, contact Customer Care to discuss alternative arrangements.

There is no limit to the number of eligible Lifetime Care requests, including after a previous replacement. The applicable Care Fee is payable for each replacement.

You must still have the damaged sunglasses when making a Lifetime Care request. 2nu reserves the right to require you to return the damaged pair for assessment or replacement processing. Customer Care will confirm any return instructions before you send it.

For coverage, exclusions, Care Fees and the request process, see our Lifetime Care Program page.

Limitation of Liability

Subject to any liability that cannot be excluded or restricted under Hong Kong law, including Cap. 71 section 7(1) and section 11(2): 2nu's total liability arising out of or in connection with the Purchase Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the most recent Purchase Price paid by you under these Terms or where you have not paid the Purchase Price, then the total liability of 2nu is the resupply of information or Purchase Services to you.

Subject to any liability that cannot be excluded or restricted under Hong Kong law, including Cap. 71 section 7(1) and section 11(2): you expressly understand and agree that 2nu, its affiliates, employees, agents, contributors, third party content providers and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.

2nu is not responsible or liable in any manner for any site content (including the Content and Third Party Content) posted on the Website or in connection with the Purchase Services, whether posted or caused by users of the website of 2nu, by third parties or by any of the Purchase Services offered by 2nu.

You acknowledge that 2nu does not provide the Delivery Services to you and you agree that 2nu will not be liable to you for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Delivery Services.

Indemnity

You agree to indemnify 2nu, its affiliates, employees, agents, contributors, third party content providers and licensors from and against: all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any Content you post through the Website; any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms; and/or any breach of the Terms. This indemnity does not require you to indemnify 2nu against any liability that cannot be excluded or restricted under Hong Kong law, including Cap. 71 section 7(1).

Dispute Resolution

If a dispute arises out of or relates to these Terms, either party may commence Tribunal or Court proceedings in Hong Kong. Urgent interlocutory relief is also available. A party may give the other party written notice describing the dispute and the outcome sought. The parties may attempt to resolve the dispute by negotiation. Neither notice nor negotiation is a condition to commencing proceedings, and these Terms do not require either party to wait a fixed period before commencing proceedings.

The parties may, by mutual written agreement, submit the dispute to mediation in Hong Kong. If they agree to mediate, they will agree the mediator, the rules that will apply, the venue, and how the fees and expenses of the mediation are to be borne. These Terms do not authorise any institution to appoint a mediator, and they do not incorporate the HKIAC Mediation Rules, unless the parties later agree in writing to that appointment or to those Rules.

Confidential:

All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

Governing law and jurisdiction

These Terms are governed by the laws of Hong Kong.

If the parties agree in writing to mediate a dispute, that mediation is to be conducted in Hong Kong. The Mediation Ordinance (Cap. 620) applies where the mediation is conducted wholly or partly in Hong Kong or the agreement provides that Hong Kong law applies to the mediation.

Subject to any right that cannot be excluded by agreement, the courts of Hong Kong have jurisdiction.

Independent Legal Advice

Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

Severance

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
